Yandex made a proposal to make adjustments to the Russian “Anti -Pirate Law”. The main point is to remove the provisions on “information intermediaries” from the law, the official blog of the largest domestic search engine informs.
“It should be removed from the law of the so -called“ information intermediaries ”, providing the possibility of access to the material and publishing the information necessary for their receipt. It turns out that the possibility of accessing the material may be understood to be referred to the transfer of references to this very material. By posting or transferring a link to someone, you provide the possibility of accessing those materials that are located on it. In this case, you are the same “information mediator,” the Yandex press release reads.
Yandex experts call the blocking of Internet sites according to the statements of copyright holders an excessive and unjustified measure, it can be used only in cases when it comes to truly pirate sites.
In addition, Yandex considers it impossible to preliminary moderation of the content placed on online resources, in view of the impossibility of manual processing of such large volumes of information.
The law, from the point of view of representatives of the search engine, should regulate the interaction of copyright holders and those who fall under the definition of an “information intermediary”. “At this stage, upon receipt of an application from the copyright holder, the content must be immediately removed, but the legality of its placement is not established by anyone. And even if there is evidence that the statement of the copyright holder is false, the information intermediary does not have the right to restore remote content on his website. The law simply does not provide for such a procedure “.
According to Yandex, copyright holders should be responsible for the false statement and for abuse of office – for example, when the copyright holder requires the information that was loaded directly by himself or from his approval.
